The Zoning, Planning & Building Department is responsible for the administration of the Marshall County Zoning Ordinance as well as the Land Development Standards and Regulations adopted by the County

The Building Department is also tasked with issuing building permits for structures and enforcing the 2018 International Building Code as well as conducting building inspections during the course of construction of these structures.

What Is Zoning?

Zoning regulates land use within a municipality. It controls the ways that land can be developed and what purposes the zoned land can serve. It is what makes a residential neighborhood residential, an industrial district industrial and so on.

Can I live in a pre-manufactured storage building/shed?

No, these structures do not meet the required building codes adopted by Marshall County.

How do I find out what the zoning is on my property?

To find out what a particular property is zoned, please call 662-252-3663 with the name the property is owned in, or the property parcel number which can be found on your deed or Delta.com or by calling/visiting the county tax assessor’s office. 

Can a homeowner obtain permits and perform work on their own property?

Yes, owner/occupants can obtain a building permit for their own property.  However, it is required to electrical, plumbing, and mechanical contractors for these services.  These contractors must be licensed in the State of Mississippi and have a current registered number with the Mississippi Board of Contractors.  All work must comply with the building codes adopted by Marshall County.

Is a building permit required to enclose an existing covered patio?

Yes, a building permit is required for this type of building alteration. A patio slab is not typically constructed with a foundation and will require some additional support to carry the loads of the new walls and windows. Also, many enclosed patios include extensive use of windows and glass doors, therefore code issues involving tempered glass and lateral bracing requirements should be discussed with a Plans Examiner. The use of metal structural components will require engineered drawings, which are signed and sealed by an engineer licensed in the State of Mississippi.

How long is a building permit valid?

A building permit is valid for six months; if any inspections are made within the initial six month period, the permit will automatically be extended for an additional six months from the date of inspection. If building activity or inspections do not occur within any six month period, the permit will expire unless extended by written request from the permittee.

Do I need to Schedule an inspection?

The permit holder is responsible for scheduling all required inspections before any work is covered or concealed. To schedule inspections please contact the Zoning office at 662-252-3663

Do contractors have to be licensed?

YES! Electrical, Mechanical, and Plumbing contractors must be licensed with the State of Mississippi Board of Contractors and have license number available at time of permitting appointment.

Can I make changes to the permitted plans?

Changes or revisions made to the reviewed set of construction documents must be submitted to Zoning for approval. Contact us if you are planning any changes, before the work is done.

How do I apply for a business permit?

The application for building permits can be found in the Department of Planning, Zoning and Development which is located on 545 JM Ash Drive, Holly Springs, MS  38635.  An appointment must be made prior to review of plans please call 662-252-3663.

 There will be a fee assessed based upon the scope of the work/service being provided.

Can I operate a businesses from home?

Businesses operated from the home of an individual must obtain a Business Permit

Restrictions:

Home occupation is for “in home” only, no outside structure.  Business office/operations must be operated and located  inside the home. 

No retail trade and no stock on the premises

No increase in traffic to and from the dwelling

No mechanical equipment other than that normally permitted for household purposes and no signs permitted

No employees except for family members residing on the premises

No display or artificial lighting that will indicate from the exterior that the dwelling is being utilized in whole or in part for any purpose other than that of a dwelling

No changes to the exterior of the structure

A permit granted for a home occupation will be given on a yearly basis by the Zoning Administrator only during the occupancy or ownership of the person to whom it was granted.

What are the requirements for a food truck?

Food trucks and push carts must be located, while in operation, on a commercial property.

After obtaining zoning location approval from Marshall County Zoning office:

They must also obtain a Business Tax Certificate (a.k.a. business license) from Marshall County.

  • Marshall County Zoning office will write a letter of recommendation $25.00 fee, which can be paid for with cash, check or money order.

Documentation of the following must be obtained prior to the above.

  • Must obtain permits for their Base of Operation and their food truck from the Mississippi Department of Public Health prior to operation.

What are the requirements for constructing a storage building?

In general, all storage buildings (Sheds) require a building permit. If the storage building has a permanent foundation, however, a permit is required regardless of size.. Property owner is still responsible for locating the accessory building within the minimum zoning setbacks and that its height does not exceed the height of the main dwelling unit.

I have a dilapidated property next door what should I do?

If you have a blighted or dilapidated property in your neighborhood you can file a complaint with Marshall County 901-252-3663

Can I purchase a used mobile home?

County ordinances state that any mobile homes placed can be no older than 8 years old.

I am installing a new manufactured home. What steps do I need to follow?

  1. Contact Marshall County Zoning office 662-252-366.prior to purchasing your new manufactured home to make sure manufactured homes are permitted on your property.
  2. If a manufactured home is permitted, you will need to apply for a Marshall County address. You may obtain an address application at XXXX????
  3. After receiving your new address, you will need to apply for a waste water permit from the Mississippi State Department of Health at https://msdh.ms.gov. You may also apply for an electrical service at this time but power will not be connected to the new home until a waste water system has been installed and approved.
  4. Stake the location of the new home and contact the Marshall County for a peirhole/peir/setback inspection.
  5. Following a satisfactory inspection, install the home. Your manufactured housing installer should assist in meeting the Mississippi State Fire Marshall Requirements for mobile home sites and waste water system installation.
  6. Upon receipt of final waste water system approval from the Mississippi State Department of Health, Marshall County will authorize the connection of utilities to the new home.
  7. Post your address at the road and or on your home with 4” contrasting numbers.
  8. Enjoy your new home!
